1. Acceptance of terms
These Terms of Service (“Terms”) govern your use of the websites, applications, and services provided by Stokt, LLC (“Stokt,” “we,” or “us”) (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Permitted use
You may use the Services only in compliance with these Terms and all applicable laws. You agree not to misuse the Services, including by reverse-engineering, interfering with their operation, probing for vulnerabilities without authorization, or using them to violate the rights of others.
3. Intellectual property
The Services and all related content, including software, design, text, and trademarks, are owned by Stokt, LLC or its licensors and are protected by intellectual property laws. Stokt™ is a trademark of Stokt, LLC. No rights are granted except as expressly set out in these Terms.
4. App Store terms
Applications distributed through the Apple App Store are also subject to Apple’s Licensed Application End User License Agreement. In the event of a conflict, Apple’s terms govern the licensed application itself.
5. Disclaimer of warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
6. Limitation of liability
To the maximum extent permitted by law, Stokt, LLC will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or revenues, arising out of your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.
7. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Any disputes arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Delaware.
8. Changes to these terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use of the Services after a change constitutes acceptance of the revised Terms.
